Validation, a short guide part II – How to perform validation?

Validation is, to put it simply, an activation of the right of protection for a patent in the territory of a country being a signatory of the European Patent Convention. Once a European patent has been obtained, it should be validated in the countries chosen by the proprietor, so that the invention is protected in those countries.  

In order to validate in Poland a previously obtained European Patent, we have to remember about fulfilling a good number of formal requirements.

Izabella Dudek-Urbanowicz comments the new UPRP project in daily Puls Biznesu

Izabella Dudek-Urbanowicz, Managing Director of Patpol, comments in the latest article in daily Puls Biznesu by Dorota Zawiślińska entitled “What will the company gain from the protection of intellectual property?”.

The article informs about the new project of the Polish Patent Office “Intellectual property in your company”, thanks to which small and medium-sized companies can now obtain up to 95% co-financing of the costs of IP consulting services.

In her comment, Izabella Dudek-Urbanowicz emphasized the benefits of the new program, including raising awareness of IP and giving entrepreneurs the opportunity to consult external experts.

However, she indicated that we need more time to evaluate the effectiveness of the project.

Izabella Dudek-Urbanowicz awarded as IP Star 2021

Congratulations to Izabella Dudek-Urbanowicz, Managing Director at Patpol, who was awarded by IP STARS (Managing IP) with the “Trademark star 2021” title.

IP Stars is an international list of the best companies and individual specialists dealing with intellectual property law.

The authors of the ranking recommend experts based of their knowledge, market position as well as achievements and results for the clients.

Validation, a short guide part I – What is validation?

The word “validation” by itself has a few meanings. The Dictionary of the Polish Language defines validation as “the generality of actions performed with the aim of checking the appropriateness, relevance or accuracy of something” [1].

Wikipedia provides various definitions of this word, depending on the field, in which it is used. For example, validation “in technical science and information technology is the action performed in order to obtain a confirmation, in a documented manner being consistent with the assumptions, that the procedures, processes, devices, materials, activities and systems truly lead to obtaining the pre-planned results.” [2]

One of online dictionaries of the Polish language provides three definitions of this word. The last of them is very close to our context: “formerly: confirmation, becoming effective” [3].

Validation of a European Patent means that an invention is protected in the given territory and the proprietor is entitled to use it for making profits. If such patent is infringed, then the proprietor will be able to undertake the relevant actions in order to enforce one?s protection rights, such as bringing action for patent infringement to the court. If a patent is not validated in the territory of a given country, then the invention covered by that patent will not be protected in this territory. What is essential to note, the protection resulting from a European Patent works only in the countries where the validation has been done.
